1. Formation of Contract
After placing an order on our standard order form, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy Products. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending an e-mail, phone call, or message confirming that the Product has been approved and dispatched or is in the Dispatch process. The order will only be formed when we send you the Dispatch Confirmation. If we cannot accept your order for any reason, we will inform you in writing as soon as practicable, and you will not be charged for the Product or any charge applied will be credited back to your account immediately. The order will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We are not obligated to include any additional item not listed or that we do not offer.
2. Vouchers and Gift Cards
We may offer gift cards, discount promotions, and other types of vouchers ("Voucher") which require activation by email for the holder to commence delivery of Products through a Service. If paid for, the Voucher is deemed to have been sold at the time of payment. All these terms and conditions shall become applicable when the Holder redeems the Voucher by applying for a Service to commence. A Voucher may only be used once by its Holder and may not be copied, reproduced, distributed, or published without our prior written approval. We reserve the right to withdraw or deactivate any Voucher for any reason at any time. Vouchers may only be redeemed through the website www.flowrista.com and not through any other website or method of communication. To use your Voucher, you must enter its unique code at checkout. Discounts attached to Vouchers apply only to the price of the Products and not to delivery charges.
3. Availability and Delivery
By placing an order on our website (www.flowrista.com), you acknowledge that dispatched products might have slight differences in flower or balloon colors from the displayed pictures. This does not grant the right to a refund. Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation.
4. Risk and Title
Products will be your responsibility from the time we deliver them to the address provided in the order form and upon signing the delivery receipt. Ownership of the Products will only pass to you when we receive full payment, including delivery charges.
5. Price and Payment
The price of the Products and delivery charges will be as quoted on our site, except in cases of obvious error. Delivery fees may vary based on location. Product prices and delivery charges may change, but changes will not affect confirmed orders. Payment for all Products and Services may be made via cash, credit/debit card, or online payment links sent through WhatsApp or email. We accept Visa and Mastercard.
6. Refund Policy
Flowrista offers a 100% Customer Satisfaction Guarantee. If your flowers are damaged during delivery or if the bouquet was not received, we will issue a full refund. Compensation is subject to verification that the bouquet was not delivered as expected. Customers must report any issues within 24 hours of delivery to qualify for a replacement or partial refund in Flowrista credit (valid for 12 months). Flowrista is not liable for delays beyond its control. Refunds are processed through the original payment method, with Flowrista credit refunds reflected within 72 hours.
7. Our Liability
Subject to our refund policy, if we fail to comply with these terms, we shall only be liable for the prepaid price of the Products or a replacement of the damaged product.
8. Cancellation Policy
Paid orders can be canceled for a full refund if requested within 30 minutes of order completion. Exceptions apply to edible and branded items. Flowrista reserves the right to cancel an order in cases where delivery is not possible, product availability is an issue, or the recipient’s address is outside our delivery zone. If an order is fully prepared and the recipient cannot be reached after three failed delivery attempts within 48 hours, the order may be canceled without a refund.
9. Rescheduling Orders
Customers can reschedule an order up to 10 days in advance if it has not been prepared. Otherwise, rescheduling is allowed for up to 48 hours. Edible and branded items cannot be rescheduled.
10. Return Policy
If a product is damaged or of low quality, customers must report the issue within 24 hours. The item must be returned unopened, unused, and in its original packaging within 24 hours. Flowrista will process refunds for eligible returns. Excluded items include flowers, underwear, beauty products, grooming items, earrings, candles, software, video games, fresh produce, custom orders, and edible items.
11. Intellectual Property Rights
We own or license all intellectual property rights in our site and published material. You may print or download extracts for personal reference but cannot use our copyright materials for commercial purposes without a license. By posting comments about our Products or Services, you grant us the right to use them in advertising and social media.
12. Events Outside Our Control
We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to strikes, natural disasters, terrorism, war, and transport disruptions. Our obligations under a contract will be suspended during the Force Majeure Event, and we will take reasonable steps to resume normal operations.
13. Our Right to Amend These Terms and Conditions
We reserve the right to review and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, advancements in technology, modifications in payment methods, updates to relevant laws and regulatory requirements, and enhancements to our system’s capabilities.
You will be subject to the policies and terms and conditions in effect at the time you place an order unless any changes are required by law or governmental authority. In such cases, the revised terms will also apply to orders previously placed by you.
