1. Formed between you and us:

After placing an order on our standard order form, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy Products. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail or phone call or message confirms that the Product has been approved and dispatched or in the Dispatch process. The order will only be formed when we send you the Dispatch Confirmation. If we cannot accept your order for whatever reason, we will inform you of this in writing as soon as practicable and you will not be charged for the Product or any charge applied will be credited back to your account immediately. The order will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation as itemized in product details and we are not obligated to include any additional item not listed or we do not offer.

 

2. Vouchers and Gift Cards:

We may offer gift cards, discount promotions and other types of the voucher (Voucher) which require activation by email for the holder to commence delivery of Products through a Service. If paid for, the Voucher is deemed to have been sold at the time of payment for it. All of these terms and conditions shall become applicable as between us and the holder of the Voucher (Holder) when the Holder redeems the Voucher by applying for a Service to commence. A Voucher may only be used once by its Holder and may not be copied, reproduced, distributed, or published either directly or indirectly in any form or stored in a data retrieval system without our prior written approval. We reserve the right to withdraw or deactivate any Voucher for any reason at any time, Vouchers may only be redeemed through the website www.flowrista.com and not through any other website or method of communication. To use your Voucher, you will be required to enter its unique code at the online checkout and use of such code will be deemed to confirm your agreement to these terms and conditions and any special conditions attached to the Voucher. Any discounts attached to Vouchers apply to the price of the Products ordered only and not to delivery charges, which will be chargeable at normal rates, we reserve the right to exclude the use of voucher codes on specific Products.

 

3. Availability and delivery:

You confirm by placing an order on our website {www.flowrista.com} your acknowledgment that dispatch products might have a slight difference in the flowers or balloons color only then the displayed pictures on the website which does not give our customer the rights to the refund. Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation.

 

4. Risk and Title:

The Products will be at your responsibility from the time we deliver the Product to the address you gave us on the order form and by signing on the delivery receipt. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

 

5. Price and Payment:

The price of the Products and our delivery charges will be as quoted on our site, except in cases of obvious error. If you are unhappy with your flowers due to the bouquet being damaged during delivery or if the bouquet did not arrive, we guarantee a full refund for the total prepaid amount. In such incidents, {Flowrista} has the right to offer appropriate compensation, provided it can be shown that the bouquet you were charged for was not provided as it should have been, subject to verification and approval by {Flowrista}.
For any concerns related to your order, please contact Flowrista Customer Service within 24 hours of the delivery, and we will promptly arrange for a replacement if needed. If a replacement is not necessary, you may qualify for a partial refund. Our team may request a photo of the received items to gain a better understanding of the issue and offer the most suitable resolution.
We assure you that your order will be delivered punctually. In the rare event of a delay exceeding 4 hours past your designated timeslot, please get in touch with Flowrista Customer Service, and they will assist you appropriately. It's important to note that this policy does not apply to orders delayed due to circumstances beyond our control.
If the recipient details provided are inaccurate, Flowrista will not be liable for any refund or compensation due to delays or deliveries to an incorrect person or address. Flowrista holds no responsibility for the recipient's refusal to accept a gift or arrangement.If a bank refund is initiated, it will exclusively be processed through the initial payment method used, such as credit or debit cards, for orders placed via the online payment gateway on Flowrista Platforms. We strive to expedite the refund process to the best of our ability.
 

7. Our Liability:

Subject to our refund policy, if we fail to comply with these terms and conditions, we shall only be liable to you for the prepaid price of the Products or replacing the damaged product with a new one.

 

8. Cancellation Policy:
Submitted and Paid orders are eligible for a full refund only if the cancellation request is communicated to us via mail, phone call, or message within 30 minutes of completing the order (before order preparation and delivery). This is unless alternative terms have been agreed upon and approved by {Flowrista}.
Additional Information:
Upon receiving your request, our team initiates the preparation and coordination of the finest gifts and flowers. Fulfilling cancellation requests is challenging because preparations commence promptly upon receipt to ensure timely delivery. Therefore, halting or canceling a delivery attempt or an order already in preparation becomes very challenging.
Items categorized as edible and branded are not eligible for cancellation.
Flowrista may find it necessary to cancel an order under certain uncommon circumstances. In such instances, you may be entitled to a full refund at the discretion of Flowrista. These circumstances may include the inability to confirm or deliver your order, the recipient's address falling outside our delivery zone, unavailability of the product, or any reason hindering the processing of your order where a suitable replacement cannot be found after reaching out to you.

We are sorry to inform you that in cases where we have fully prepared your order and are unsuccessful in reaching you or the recipient promptly, or after three unsuccessful delivery attempts within 48 hours, your order may be canceled without a refund.

9.Rescheduling Orders:
we acknowledge that there may be situations where you wish to reschedule your order, and we will make every effort to accommodate your request. If your order has not been prepared, you can reschedule it for a maximum of 10 days. Otherwise, you can reschedule it for up to 48 hours later to ensure the delivery of the highest quality products.
Please be aware that the rescheduling option does not apply to any edible or branded items.
10. Return Policy:
if you aren't satisfied with the quality of our products and wish to return the delivered items due to damage or low quality, please contact our customer service team via our platforms to arrange a pick-up within 24 hours of delivery. You will have 24 hours to return the product(s), and Flowrista's return policy will comply with the applicable laws of the country.
Ensure that the received items are unopened, unworn, unused, and still in their original packaging with the tags attached. While we do not facilitate exchanges at the moment, we do provide full refunds for eligible returns in cases where the received product is damaged upon delivery.
Upon receiving the return request, Flowrista will conduct a quality check of the product to be returned. Following this, you will receive an email confirming the approval of your return request and providing information on the refund processing time.
Please note that this return policy applies only to damaged or low-quality items. The following items are not covered by this return policy: flowers,underwear, beauty, grooming, earrings, candles, Software, video games, fresh produce, custom orders, and all edible items.

11. Intellectual Property Rights:

We are the owner or the licensee of all intellectual property rights in our site, whether registered or unregistered and in the material published on it. These works are protected by copyright laws and all such rights are reserved. You may print off one copy and may download extracts, of any pages from our site for your personal reference. You must not use any part of our copyright materials for commercial purposes without first obtaining a license to do so from us and our licensors. If you post comments on the Products or Services to any website, blog, or social media network (Commentary) you must ensure that such Commentary represents your fairly-held opinions. By subscribing to the Services, you irrevocably authorize us to quote from your Commentary on our site and in any advertising or social media outlets that we may create or contribute to. {Flowrista} has no liability for any comments posted by you on any website, blog, or any social media.

12.Events outside our control:

We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Major Event). A Force Major Event includes any act, event, non-happening, omission, or accident beyond our reasonable control and includes in particular (without limitation) the following: Strikes, lock-outs, or other industrial action; Civil commotion, riot, invasion, terrorist attack or the threat of terrorist attack, war (whether declared or not), or threat or preparation for war; Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters; Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport; Impossibility of the use of public or private telecommunications networks; and  The acts, decrees, legislation, regulations, or restrictions of any government. Our performance under any Contract is deemed to be suspended for the period that the Force Major The event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Major Event.

 

 13.Our right to vary these terms and conditions:

We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements, and changes in our system’s capabilities. You will be subject to the policies and terms and conditions in force at the time that you order Products from us unless any change to those policies or these terms and conditions are required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).
